Golf Clubs hire terms and conditions



ONLINE BOOKING
Please read our General Golf Clubs hire Terms and Conditions when applying for the service of golf equipment hire, as you will be asked to confirm that you have read and understood it before we confirm and process your booking. Please note that when you make your reservation, Cargest S.L. will charge your credit card a deposit of 50% of the amount due for the entire Hire Period (as defined below). By acknowledging this Agreement, you also authorize Cargest S.L. to charge the Hirer's credit card for any late, lost, stolen, broken, non-returned equipment, and for all other amounts payable under the terms and conditions of this Agreement.

Cargest does not take deposit to his customers. Cargest will make a blockage on the client’s credit card with 300 euros in order to cover events such as: breakage by misuse or disappearance of the golf clubs, thieves, etc. This warranty expires automatically after 15 days ( depending on the bank ) from the date of the blockage.

SPECIFIC TERMS & CONDITIONS

1. Credit Card Payments Only:
All Hires and purchases that you make through Cargest S.L. will be transacted by means of a valid credit card at the time of making a reservation. Hirers hereby authorize Cargest S.L. to charge their credit card with any amounts due plus any late, lost, stolen, broken, non-returned equipment, and for all other amounts payable under the terms and conditions of this Agreement.

2. Booking Constraints:
a) Booking Date: -Cargest S.L. can accept bookings for with at least 3 days advance notice
b) Minimum hire duration: - The minimum Hire Period is 1 day and hires of less than 24 hours will be charged as a full days rate.
c) Maximum hire duration: - The maximum Hire Period is 4 weeks. For longer rental period, please consult prices and viability
d) Subject to Availability: -Cargest S.L. will make all reasonable efforts to provide you with the Equipment you order. However, please note that due to unknown factors such as Equipment not being returned on time, insufficient lead time, lost or stolen equipment, etc., all of our Equipment is subject to availability. If the Equipment you desire is unavailable, we will endeavor to replace it with equipment of the same standard that is apt to fulfill the same purpose.

3. Delivery And Collection
a) Pick-up and Return of Equipment: Equipment shall be picked-up on the First Hire Day and shall be returned on the Last Hire Day at the airport premises of Cargest S.L. (nr. Málaga airport)
b) At the time of set of clubs booking, when more than one set is needed, Clients must provide us with other player's passport and an up dated credit card.
c) At the time of the equipment release from our pick up point clients must produce the following: Passport- Valid Credit card-A copy of the booking confirmation.

4. Commitments / Duties
a) Cargest S.L. Duties
i. Deliver the Equipment on the First Hire Day, subject to clause 2.d
ii. Ensure that the Equipment is apt to fulfill its objective
b) Clients duties:
i. Pay the price referred to in Clause 5
ii. Not to use the Equipment for different purposes
iii. Not to use the Equipment imprudently
iv. Allow Cargest S.L. to examine the Equipment at any time
v. Allow any urgent repairs to the Equipment
vi. Inform Cargest S.L. immediately if there is any fault or defect
vii. Return the Equipment in its initial condition on the Last Hire Day
c) Repossession of Equipment: Cargest S.L. reserves the right to request the return of the Equipment or to repossess the Equipment if you do not comply with your duties as above, or if the Equipment appears to be abandoned. In the event of repossession, Cargest S.L. reserves the right to charge your credit card for the full Hire Period or for any period thereof.

5. Prices
a) All prices shall be as listed on the website, and are subject to change without notice. The prices are guaranteed for the hire associated to the confirmed booking. The prices take into account all mandatory charges and include Value Added Tax or any other local tax.
b) Additional charges may be levied in the following situations:
i. Damages & Theft: up to the limit of the Equipment's manufacturer's suggested retail price
ii. Failure to Return the Equipment: failure to return the Equipment for any reason on the Last Hire Day or when requested to do so by Cargest S.L., will result in our charging your credit card the full amount of the manufacturer's suggested retail price for the Equipment, in addition to any charges for the Hire Period.

6. Payment / Credit Card
a) Payment: Cargest S.L. will charge your credit card for the amount of 50% of the entire Hire Period when you make your online booking and by accepting this agreement you hereby authorize this charge, and the balance will be charged on the pick-up day of the equipment at Cargest S.L. head office. In addition, by accepting this agreement, you also authorize Cargest S.L. to charge the your credit card for any late, lost, stolen, broken, non-returned equipment in accordance with Clause 6.2 and for all other amounts payable under the present terms and conditions.
b) Method of payment: Payment can be made using the following credit cards: MasterCard and Visa. Payment using credit card is accepted in accordance with the limits authorized by your credit card issuer.

7. Changes To Reservation: Modification / Cancellation Policy
a) Cancellations: You may cancel this agreement at any time by notifying Cargest S.L. by email of your intention to cancel. Clubs can only be cancelled by email; phone's cancellations cannot be accepted.
b) Our Services cancellations policy:
i. A minimum charge of €10 plus bank charges will apply to all cancellations.
ii. For cancellations of less than 28 days from pick up date, a charge of 30% of the value of the booking plus bank charges.
iii. For cancellations of less than 14 days a charge of 50% of the value of the booking plus bank charges will apply.
iv. For bookings cancelled less than 7 days but more than 48 hours from date of pick up a 75% of the value of the booking plus bank charges will apply.
v. No refund will apply to bookings cancelled less than 48 hours from date of pick up. Our online cancellation policy supersedes all other written contracts that may be signed at our shop locations.
c) Unused Booking: Equipment that is scheduled to be picked up will be kept for 12 hours and then cancelled (unless rebooked). If the golf hire equipment is not picked up, no refund will apply.
d) Changing Bookings and Extension of Hire Period:
We will do our best to accommodate any changes that you may wish to make to your booking, including any extensions that you may wish to make to the hire period. Please note however, that any such changes are subject to availability particularly when requested within 72 hours or less of your First Hire Day.
8. Other Terms
a) Nothing in these terms and conditions will affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of Cargest S.L. You expressly acknowledge and agree that Cargest S.L., its officers, directors, employees will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data or other intangible losses (even if Cargest S.L. has been advised of the possibility of such damages), resulting from the online booking.
b) Neither party shall be liable for failure in its performance hereunder caused by any case of Majeure Force.
-Majeure Force shall be considered - as defined by the applicable regulation(s) - as any irresistible or unforeseeable event, independent of the party suffering of the case of Force Majeure, which prevents this party from fulfilling its obligations.
c) Any change in this Agreement must be in writing and must be signed by the parties hereto.
d) You do not acquire any ownership or other interest in the Equipment except as specifically set forth herein.
e) This Agreement constitutes the entire agreement between the two parties.
